MASTER TERMS OF SERVICE

1. Acceptance of Terms

Welcome to FansChoice Polls. By accessing or using our platform, you agree to be bound by these Master Terms of Service and all applicable user-specific terms. If you do not agree, please do not use the platform.

These terms apply to all users, including Event Organizers, Ticket Sellers, Voters, Ticket Buyers, Contestants, and anyone purchasing products or services through our platform.

2. About FansChoice Polls

FansChoice Polls (“FansChoice,” “we,” “us,” or “our”) provides a technology platform that enables event organizers, ticket sellers, brands, and partners to:

  • Create and manage events

  • Sell tickets to the public

  • Run e-voting campaigns

  • List and sell products or services

  • Process payments and payouts

We are the technology provider. We do not organize events ourselves, and we are not the seller of any partner products or services unless expressly stated.

3. User Accounts and Eligibility

  • You must be at least 18 years old to open an account as an Organizer or Ticket Seller.

  • Voters and Ticket Buyers confirm they are 18+ or have parental or guardian consent.

  • You agree to provide accurate, current, and complete information during registration.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You must not share your account with others or use it for unauthorized purposes.

  • We reserve the right to suspend or terminate any account that violates these terms.

4. The Role of FansChoice Polls

To be clear about how the platform works:

  • Event Organizers are solely responsible for their events, contests, rules, prizes, judging, and communications with their audience.

  • Ticket Sellers are solely responsible for the tickets they list, their pricing, delivery, and attendee communication.

  • Partners, brands, and service providers who list products or services are solely responsible for the quality, delivery, and legal compliance of what they offer.

  • FansChoice Polls provides the technology, payment processing, and platform infrastructure. We facilitate transactions but are not the seller or provider of the product, service, ticket, or event.

5. Fees, Payments, and Commissions

  • Commissions: We charge a commission on all paid ticket sales, votes, and eligible product or service transactions. The exact percentage is displayed in the relevant dashboard and may vary by event, category, or partner.

  • Payment Processing: All payments are processed through licensed third-party payment gateways such as Paystack, M-Pesa, and card processors. We do not store full card details.

  • Payouts: Organizers and sellers can request payouts of net earnings after event conclusion. Payouts are processed within a reasonable timeframe, subject to verification and no active disputes.

  • Taxes: Organizers, sellers, and partners are solely responsible for declaring and remitting all applicable taxes in their jurisdiction.

  • No Refunds: All ticket purchases and votes are final. Refunds may be issued only at the discretion of the organizer or partner. See specific user terms for full details.

6. User Conduct

You agree not to:

  • Violate any applicable law or regulation

  • Use the platform to defraud, mislead, or harm others

  • Upload illegal, defamatory, obscene, or infringing content

  • Use VPNs, proxies, bots, or automation to manipulate votes or transactions

  • Attempt to hack, scrape, or disrupt the platform

  • Impersonate another user, organizer, or partner

  • Harvest or misuse other users’ data

  • Engage in any activity that damages the reputation or operations of FansChoice Polls

We reserve the right to remove content, cancel transactions, and terminate accounts for violations without notice.

7. Content Ownership and Licensing

  • You retain ownership of content you upload (event details, contestant profiles, product listings).

  • By uploading content, you grant FansChoice Polls a non-exclusive, royalty-free license to display, promote, and distribute that content on the platform and through our marketing channels.

  • You confirm you have the legal right to upload any content you provide, including images, names, and descriptions.

  • You may not upload content that infringes on another person’s copyright, trademark, or privacy.

8. Marketing and Communication

By using the platform, you agree that FansChoice Polls and our trusted partners may contact you via email, SMS, or WhatsApp with:

  • Transactional messages (receipts, tickets, confirmations)

  • Event-related updates

  • Marketing offers for events, products, or services we believe may interest you

  • Promotional content from trusted third parties

You can opt out of marketing communications at any time by using the unsubscribe link in any message or by contacting info@fanschoicepolls.com.

9. Platform Availability

We work hard to keep FansChoice Polls online and available. However:

  • We rely on third-party hosting, payment processors, and infrastructure providers.

  • Temporary downtime, network congestion, or maintenance may occur.

  • Data updates (votes, sales, payouts) may occasionally be delayed due to high traffic.

  • FansChoice Polls is not liable for losses, damages, or missed opportunities resulting from temporary unavailability or update delays.

Organizers are advised to monitor their events and maintain their own backups of critical data where feasible.

10. Limitation of Liability

To the maximum extent permitted by law, FansChoice Polls, its directors, employees, and partners shall not be liable for:

  • Any indirect, incidental, special, or consequential damages

  • Loss of profits, revenue, data, or goodwill

  • Disputes between organizers, buyers, voters, contestants, or partners

  • Delays caused by third-party banks, mobile money providers, or payment processors

  • Downtime or failures of third-party hosting or infrastructure

  • Actions or omissions of any user on the platform

11. Indemnification

You agree to indemnify, defend, and hold harmless FansChoice Polls and its team from any claims, damages, liabilities, or expenses (including legal fees) arising from:

  • Your use of the platform

  • Your violation of these terms

  • Your violation of any third-party rights

  • Any content you upload

  • Any dispute between you and another user

12. Termination

We may suspend or terminate your access to the platform at any time for any reason, including breach of these terms. You may delete your account at any time, subject to legal and financial retention requirements.

13. Dispute Resolution

We encourage users to resolve disputes directly with the relevant party (organizer, seller, or partner). If a dispute involves FansChoice Polls directly, both parties agree to attempt good-faith resolution first. If unresolved, disputes may be settled by arbitration in Nairobi, Kenya.

14. Governing Law

These terms are governed by the laws of Kenya, without prejudice to any consumer protection rights you may have in your own jurisdiction.

15. Changes to These Terms

We may update these terms from time to time. The “Last Updated” date will change. Continued use of the platform after changes constitutes acceptance.
